STATEMENT OF PRIVACY LAWS AND FOUNTAIN PARK PHARMACY PRIVACY PRACTICE POLICY

 

Effective: August 20, 2014

 

The Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule provides patients with privacy rights and protections with respect to their health information, including  important controls over how their health information is used and disclosed by health plans and health care providers. 

 

This Privacy Policy describes our policies on the collection, use, and disclosure of your information in connection with Fountain Park Pharmacy website, emails, electronic and mobile applications. When you use the Fountain Park Pharmacy, you consent to our collection, use, and disclosure of your information as described in this Privacy Policy.

 

It is the legal and ethical responsibility of all Fountain Park Pharmacy  staff/employees, students, interns, trainees, volunteers, and contractors to use, protect, and preserve personal and confidential patient, employee, and Fountain Park Pharmacy  business information, including medical information for clinical use that include a pharmacist review (referred to definition of “Confidential Information”), as in accordance with state and federal laws and Fountain Park Pharmacy policies, to include:

 

  •     Clinical appropriateness

  •     Cost effectiveness

  •     Name, address, telephone number, gender, age/date of birth of client

  •     Allergies/sensitivities of client

  •     Appropriateness of Medication prescribed

  •     Drug Regimen Review that include drug interactions including over the counter medications, food and herbals

  •     Physician name, telephone number

  •     Chief Complaint/Medical history/Diagnosis

  •     Weight, if medication is weight based with every refill to validate that the correct dose is dispensed

  •     Clients Infection and sensitivities

  •     Significant Lab Results

  •     Assess for high risk individuals e.g. pregnancy

 

Laws controlling the privacy of, access to, and maintenance of confidential information include, but are not limited to, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA. the Final Omnibus Rule of 2013 and the Health Information Technology for Economic and Clinical Health Act (HITECH.)  These and other laws apply whether the information is held in electronic or any other format, and whether the information is used or disclosed orally, in writing, or electronically to include text messaging.  It also provides guidance for by federal, local and state authorities for the enforcement law that protect a patients PHI when a healthcare organization fails to comply or meet the intents of law.

 

Your information is secured and in compliance with standard SSL security practices and is only accessible to users who have validated they have the right to access this information based on data that the patient would know.

Fountain Park Pharmacy  policies control the way confidential information may be used in accordance with Federal, State and accrediting agencies laws and/or regulation.

 

Definitions:

 

“Confidential Information” includes information that identifies or describes an individual, the unauthorized disclosure of which would constitute an unwarranted invasion of personal privacy. Examples of confidential employee, Fountain Park Pharmacy business information include home address, telephone number, medical information, date of birth, citizenship, social security number, spouse/partner/relative names, income tax withholding data, performance evaluations, proprietary/trade secret information, and peer review/risk management information and activities.

 

“Medical Information” includes the following no matter where it is stored and no matter the format: medical and psychiatric records, photos, videotapes, audio recordings, diagnostic and therapeutic report.  Medical information, including Protected Health Information (PHI), is maintained to serve the patient, health care providers, Fountain Park Pharmacy and to conform to all regulatory requirements.

 

Unauthorized use, disclosure, viewing of, or access to confidential information in violation of state and/or federal laws may result in personal fines, civil liability, licensure sanctions and/or criminal penalties, in addition to Fountain Park Pharmacy disciplinary actions.

 

1. INFORMATION YOU SUBMIT

 

We may store the information you submit to or through Fountain Park Pharmacy secure website. We use the information to provide safe and effective dispensing of medication for the customer, as approved by the providers, and as prescribed by your medical professional. A goal of Fountain Park Pharmacy is to continuously improve quality of service to the provider, prescriber and the customer by:

 

  •     Personalizing the user’s experience,

  •     Displaying relevant information,

  •     Providing customer support,

  •     Providing resources and education tools,

  •     Communicating with you by phone, in person or by electronically that are secured

  •     Backing up our systems,

  •     Having a disaster plan that includes:

    • Prevention

    • Preparedness

    • Implementation/Response

    • Recovery and;

    • complying with legal obligations.

 

Among the information you submit to or through the Fountain Park Pharmacy, please note:

 

 

A. Email Received through Fountain Park Pharmacy website or secure email:

 

Information provided to the Fountain Park Pharmacy’ by means of email will be shared only with the appropriate staff based on the information (“need to know”) or as requested in the email.  The information provided is secured including any PHI.  If you have concerns of information being transmitted via email please contact the pharmacy in person or by phone.

 

B. Profile:

 

Fountain Park Pharmacy maintains a patient profile that includes at least the following:

 

  •     Name

  •     Address

  •     Contact information

  •     Age

  •     Sex

  •     Insurance information

  •     Diagnoses

  •     Allergies and past sensitivities

  •     Prescription  which includes:

    • Medication name/Herbal/OTC

    • Route

    • Dosage

    • Frequency

    • State Date

    • PRN reason

    when appropriate or defined by the standard of practice/guideline’s

  •    co-morbidities and concurrently occurring conditions,

  •    Relevant laboratory values and regularly scheduled lab testing

  •    Height and weight when appropriate

  •    Laboratory and/or diagnostic testing results

  •    Pregnancy and lactation when appropriate

  •    Client’s ability to comply with past medication regimens

 

2. COOKIES AND OTHER INFORMATION WE COLLECT

 

In addition to the information you submit through the Fountain Park Pharmacy secure website, we may also collect and store information from and about you by means of your use of the Fountain Park Pharmacy website.  Fountain Park Pharmacy may use the information to analyze and track your behavior to personalize your web experience and improve the quality of Fountain Park Pharmacy services.

 

The collective information may use to help comply with legal obligations, and to display relevant advertising.

 

We collect this information in a couple of different ways:

 

A. Cookies:

 

We may use cookies, web beacons, local shared objects (“cookies"), and similar technology in connection with your use of the Fountain Park Pharmacy website. 3. THIRD PARTIES

 

We do not rent, share, sell or trade personally identifiable information with third parties to include direct marketing purposes. Fountain Park Pharmacy possibly uses of the information:

 

A. Aggregate Information:

 

We may share limited user information that is aggregated with third parties, such as types potential providers, manufactures/distributors, physician’s specialties, types of diseases states (ICD 9 /10), patient education selected and/or medications ,Therapeutic classes, Major Drug name, Top 10 Drugs.

 

For example, we may disclose the number of users that have been exposed to, or clicked on a distributor’s patient education for self-administration of injectable medications.

 

B. Business Transfers:

 

We may share information from or about you with subsidiaries, or other companies under common control, in which case we will require them to sign a Business Associate Agreement. If another company acquires the Fountain Park Pharmacy  or all or substantially all of our assets, that company will possess the same information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy and allowable by law.

 

C. Investigations:

 

We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is (a) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (b) helpful to prevent, investigate, or identify possible wrongdoing in connection with the Fountain Park Pharmacy ; or (c) protect our rights that are allowable by law in regards to Fountain Park Pharmacy  reputation, property, or that of our users affiliates, or the public.

 

D. Links:

 

Fountain Park Pharmacy may provide links to other resources such the manufactures of medications, FDA, clinical guidelines, disease states information, Disease specific organizations or drug information.  Fountain Park Pharmacy does not assume any responsibilities when the user opts to link to another website.  Fountain Park Pharmacy makes reasonable effort to research resources that are reputable with providing information in accordance with national acceptable standards of practice and guidelines.

 

4. DATA RETENTION AND ACCOUNT TERMINATION

 

When accessing the Fountain Park Pharmacy, information you transmit cannot be revoked. This information may include email or contact us information, refill requests, and/or updates to your account settings.

 

5. MENTAL HEALTH RECORDS

 

Generally, the Privacy Rule applies uniformly to all protected health information, without regard to the type of information. One exception to this general rule is for psychotherapy notes, which receive special protections. The Privacy Rule defines psychotherapy notes as notes recorded by a health care provider who is a mental health professional documenting or analyzing the contents of a conversation during a private counseling session or a group, joint, or family counseling session and that are separate from the rest of the patient’s medical record. Fountain Park Pharmacy will not request or retain psychotherapy notes if received, the psychotherapy notes will be destroyed and the sender will be notified.

 

6. CHILDREN

 

The Fountain Park Pharmacy is intended for general audiences and is not directed to children under 18. We do not knowingly collect personal information from children under 18. If you become aware that a child has provided us with personal information without parental consent, please contact us via email at support@fountainparkrx.com. If we become aware that a child under 18 has provided us with personal information without parental consent, we take steps to remove such information and terminate the child's account.

 

7.  SECURITY

 

We follow generally accepted industry standards to protect the personal information and PHI submitted to Fountain Park Pharmacy during all phases of transmission and receiving of information to include information transmitted over the Internet or via mobile device, or method of electronic storage.  We cannot guarantee the information is 100% secure, however we strive to comply with federal, state, local and accrediting agencies standards and laws to protect your personal information and PHI.   Also, Fountain Park Pharmacy conducts an annual risk assessment to detect potential compromises based on current information such worms, virus, and hacking methods.

 

8. DISPUTE RESOLUTION

 

If you believe that we have not adhered to this Privacy Policy you may write or contact the Compliance Officer. Fountain Park Pharmacy will respond to all requests for investigation of compliance issues, concerns or grievance in accordance with the organizations Compliance Plan or Grievance process.

9. MODIFICATIONS TO THIS PRIVACY POLICY

 

We may revise this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our use of your information and will be located here. By continuing to access or use the Fountain Park Pharmacy after those changes become effective, you agree to be bound by the revised Privacy Policy.
